Terms of Service

These Terms of Service (the "Terms") govern your use of the CLT Content Lab website at cltcontentlab.com (the "Site"), the text messages we send, and the marketing services we provide (together, the "Services"). CLT Content Lab, LLC ("CLT Content Lab," "we," "us," or "our") is a North Carolina limited liability company. By using the Site, texting us, or purchasing a service, you agree to these Terms. If you do not agree, do not use the Site or the Services.

The Site and the Services are for businesses and business owners. We do not provide services to individuals for personal, family, or household purposes.

1. Who We Are and What We Do

CLT Content Lab is a marketing agency serving local service businesses in and around Charlotte, North Carolina. Our services include video and photo production, social media management, paid advertising management, email and text messaging systems, Google Business Profile management, print and signage coordination, and brand design. Every client engagement is governed by a signed written agreement. Where these Terms and a signed agreement conflict, the signed agreement controls for that engagement.

2. Text Messaging Terms

When you provide your mobile number through the Site's chat widget, by booking a call with us, or by texting us first, you agree to receive text messages from CLT Content Lab related to your inquiry or your account. These messages may include appointment confirmations, reminders, replies to your questions, and service updates. Consent is not a condition of purchase.

• Frequency. Message frequency varies with your activity. Most contacts receive a handful of messages around a booked call and none otherwise.
• Cost. Message and data rates may apply according to your carrier plan.
• Opting out. Reply STOP to any message to stop receiving texts. You will receive one confirmation and nothing further.
• Help. Reply HELP to any message, or email say@cltcontentlab.com.
• Carriers. Carriers are not liable for delayed or undelivered messages.

Some of our clients use a service through which their own customers receive a text after a missed call or a completed job. Those messages are sent on the client's behalf, to the client's customer, and identify the client business. The client is responsible for the consent of its own customers, and every such message honors STOP.

3. Purchases, Payment, and Refunds

Prices are stated in U.S. dollars on the Site, in a quote, or in a signed agreement. Payment is due as stated at checkout or in the agreement. Where a service carries a written guarantee, the guarantee and its conditions are stated at the point of purchase, and a refund under that guarantee is the sole remedy. Otherwise, fees are non-refundable once work has started. Print and signage orders are custom manufactured and are not returnable once approved for production.

4. Your Responsibilities

• You are authorized to act for the business you represent.
• Information you give us is accurate and you will keep it current.
• You will give us the access we need to do the work, such as access to your Google Business Profile, ad accounts, or phone forwarding, and you will not withdraw it mid-engagement without telling us.
• You own or have the rights to any logo, photo, text, or other material you give us to use.
• You will not use the Site or the Services for anything unlawful, or to send messages to people who have not agreed to receive them.

5. Intellectual Property

The Site, its design, and its content belong to CLT Content Lab. Work we produce for a client, such as finished videos, photos, designs, and copy, is licensed or assigned to the client as stated in the signed agreement, and in most cases the client owns the finished deliverables once paid in full. We keep the right to show finished work in our portfolio unless the agreement says otherwise. Raw footage, working files, templates, and systems we built before or apart from the engagement remain ours.

6. Third-Party Services

We use third-party platforms to deliver the Services, including Google, Meta, LeadConnector, Netlify, and print vendors. Their terms apply to your use of their platforms. We are not responsible for their availability, changes to their policies, or actions they take on your accounts.

7. No Guarantee of Results

Marketing depends on factors outside our control, including your market, your pricing, your response to leads, and platform changes. Except where a specific written guarantee says otherwise, we do not promise a particular number of leads, calls, jobs, followers, or revenue.

8. Disclaimer and Limitation of Liability

The Site and the Services are provided as is. To the fullest extent permitted by law, we disclaim all warranties not stated in a signed agreement, and our total liability to you for any claim arising from the Site or the Services is limited to the amount you paid us in the three months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits.

9. Termination

We may suspend or end your access to the Site at any time for a breach of these Terms. Client engagements end as stated in the signed agreement.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law rules. Any dispute that cannot be resolved between us will be brought in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to that venue.

11. Changes to These Terms

We may update these Terms. The date at the top tells you when they last changed. Continued use of the Site or the Services after a change means you accept the updated Terms.
